Email marketing and newsletters: what the job involves
Planning, designing and sending email newsletters and automated emails — welcome series, abandoned-cart reminders, offers — through a platform such as Mailchimp or Klaviyo, to people who have agreed to receive them. Irish law is strict about consent, so a clean list matters as much as the design.

Marketing emails and text messages to individuals need their prior consent. Each message sent without it is a separate offence, and if consent is disputed it is for the sender to prove it. Business addresses used for work may be emailed about that work without consent, until the recipient objects.

The only exception for consumers is existing customers: a business that got a customer’s email or mobile number in the course of a sale may market its own similar products to them, if the customer was offered an easy, free opt-out when the details were collected and in every message, and the sale or the last marketing message was within the previous 12 months.

Anyone can object at any time to their personal data being used for direct marketing, and once they do it must no longer be used for that purpose. Marketing lists, custom audiences for ads and CRM data are personal data and must be handled under the GDPR.

An ad, listing or post is a misleading commercial practice if it gives false information, or is likely to deceive the average consumer, about matters such as the product’s main characteristics, the results to be expected, the price or the trader, and it would change their decision.

Safety
- Never upload a bought list, or contacts from business cards and phone books, for marketing to individuals: each email without consent is a separate offence
- Keep consent records — when and how each person signed up — because the sender must prove consent if it is challenged
- Give the provider their own user login on the platform rather than your password, and remove it at the end

Can I email people who gave me their business card?
A work email address used mainly for business can be emailed about matters relevant to that business until the person objects. Personal email addresses need consent, unless they are your customers and the existing-customer rules are met. If in doubt, ask them to sign up.
Can I email my past customers?
Yes, if you got their details in the course of a sale, you market only your own similar products, you offered an easy opt-out when you collected the details and in every email, and the sale or your last marketing email was within the last 12 months. Otherwise you need their consent.
Do text messages follow the same rules?
Yes. Under the Irish ePrivacy Regulations, "electronic mail" includes SMS, so marketing texts to individuals need the same consent or existing-customer conditions as emails.
Is there a grant for digital marketing?
The Local Enterprise Office Trading Online Voucher has been replaced by the Grow Digital Voucher. It co-funds new off-the-shelf software subscriptions and the training or set-up that goes with them, for small businesses that have first completed a Digital for Business project with their LEO — it is not a general grant for agency or marketing fees. Talk to your Local Enterprise Office, and apply before you commit to any spending.
